DECCs appeal permission hearing was held on Friday 13th January 2012. The Court of Appeal judges failed to reach a decision on whether an appeal should be allowed. A decision should be made by 9th February 2012 at the latest.
DECC have released the following statement:
"The Court of Appeal has not yet decided whether to give permission for an appeal or made a judgement on the FITs case. The Court will wrap up the decision on permission for an appeal and a possible judgement if an appeal is allowed in the next few weeks.
Once the outcome is known we will consider our options and make an annoucement on the way forward to provide clarity to consumers and industry."
If DECC wins its case they are on track to publish a new comprehensive review of Feed-In Tariffs. If it loses its case and the consultation is again deemed unlawful it is at present unclear what will happen.
